Terms of Service

Last updated: DRAFT — not yet published

DRAFT — pending a human-lawyer skim before public launch. This document is a first-pass legal draft prepared with AI assistance (product-counsel triage). GM-49's controller-identity values were confirmed by the founder on 2026-07-22 and are filled in below, but this is still not final legal advice and must not be treated as cleared copy until a qualified lawyer has reviewed it — see the Privacy Notice (Section 1) for the specific open question (postal address) flagged for that review.

Terms of Service

These terms govern your use of GearManifest (the "Service"), operated by Simo Parviainen, as a private individual based in Finland (no registered business / Y-tunnus). By creating an account or using the Service, you agree to these terms. If you have questions, contact Hi@polkuopas.fi.

1. What GearManifest is

GearManifest is a personal gear-inventory and trip-loadout planning tool for hikers. You log the gear you own, optionally get AI-assisted spec suggestions, and organize items into named "builds" (loadouts) with automatic weight totals.

2. Cost — free product, no paid tier

GearManifest is currently free to use, with no paid tier. There is no subscription, no payment processing, and no premium feature gate in this version of the product. If GearManifest introduces paid features in the future, these terms will be revised accordingly before any payment is collected, and you will be notified of the change.

3. Your account

  • You need a valid email address to create an account; we use passwordless "magic link" sign-in.
  • You're responsible for keeping access to your email account secure, since that's how sign-in works.
  • You must be old enough, under the law of your country of residence, to agree to these terms on your own behalf.

4. Acceptable use

You agree not to:

  • Scrape, systematically crawl, or bulk-extract data from GearManifest (including its public pages) other than through features we explicitly provide for that purpose.
  • Abuse, automate, or attempt to circumvent rate limits on the AI SKU-lookup endpoint (/api/sku-lookup) — for example, by scripting high-volume requests, probing it for uses unrelated to looking up your own gear, or attempting to extract the underlying AI system's behavior at scale.
  • Enter illegal content (including content that infringes someone else's rights, is defamatory, or violates applicable law) into any field in the product, including gear notes, build notes, or any other free-text field.
  • Attempt to access another user's data, interfere with the Service's operation, or reverse-engineer the Service beyond what applicable law permits.

We may suspend or terminate accounts that violate this section.

5. AI-assisted content and accuracy

GearManifest's SKU-lookup feature uses AI to suggest gear specifications (such as weight) based on the product name and model you provide. These suggestions are estimates, not verified facts. AI-sourced values may be inaccurate, outdated, or simply wrong — manufacturers change specs, AI models can misattribute figures, and product naming is inconsistent across brands. GearManifest visibly distinguishes AI-estimated values from values you've entered or confirmed yourself, but the distinction is a labeling aid, not a guarantee.

Do not rely on GearManifest's weight figures, AI-estimated or otherwise, for safety-critical decisions — for example, load-bearing limits, extreme weather margins, or any situation where an inaccurate gear weight could put you at risk. Always verify critical gear specifications against the manufacturer's own published data or by weighing the item yourself.

5.1 Where a specification came from

GearManifest may show you a specification that did not come from your own entry. Every such value carries a visible note telling you what it is, and all of them are advisory only:

  • Manufacturer-stated. Read from the manufacturer's own published product page on the date shown beside it. A date is not a guarantee of currency — manufacturers revise specifications between model years and production runs, and a figure that was correct when we read it may no longer describe the item you own.
  • AI estimate. Produced by an AI model from a product name. It has no source, has not been verified by us, and may be wrong.
  • Contributed by other users. Derived from another person's AI lookup that they accepted into their own inventory. We have not checked it. It reflects what one or more other people were willing to accept, which is not the same as it being correct.

None of these is a manufacturer's warranty, and none of them is checked by us on your behalf. Treat every one of them as a starting point to correct, not as a fact to rely on — particularly for sleeping bags and pads, shelters, stoves and water treatment, where a wrong figure can matter to your safety. You can edit any value we show you, and your own entry always takes precedence over ours.

6. Third-party brands and products

GearManifest lets you record and reference third-party gear brands, product names, and models as part of your own inventory data, and (in future public pages) may discuss specific products by name. Referencing a brand or product name does not imply any affiliation, sponsorship, partnership, or endorsement between GearManifest and that brand, nor does it imply the brand endorses GearManifest. All third-party trademarks referenced belong to their respective owners and are used only to identify the products they refer to (nominative use).

7. Your content

You retain ownership of the gear, build, and note data you enter into GearManifest. You're responsible for making sure you have the right to enter any content you add (for example, don't paste in someone else's copyrighted product descriptions wholesale). We process your content only to provide the Service to you, as described in our Privacy Notice.

8. Disclaimer of warranty and limitation of liability

The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-sourced data will be accurate (see Section 5).

To the fullest extent permitted by applicable Finnish and EU law, Simo Parviainen will not be liable for indirect, incidental, or consequential damages arising from your use of the Service, including damages arising from reliance on inaccurate gear specifications.

This limitation may not apply in full where you are a consumer. Finnish and EU consumer-protection law grants consumers rights that cannot be waived or limited by contract, and some liability limitations that would be enforceable in a business-to-business context may be unenforceable against a consumer. This is flagged explicitly as a point the pre-launch lawyer review must check — nothing in this section is intended to, or should be read to, override a mandatory consumer-protection right that applies to you under Finnish or EU law.

9. Changes to the Service or these terms

We may change or discontinue features of the Service, and may update these terms as the product evolves (for example, when GDPR export/deletion self-service ships, or if a paid tier is introduced). We'll post an updated version here with a new effective date once this document leaves draft status.

10. Governing law

These terms are governed by the laws of Finland, without regard to its conflict-of-law principles. If you are a consumer, this choice of law does not deprive you of the protection of any mandatory provisions of the law of your country of habitual residence.
